These General Terms and Conditions of Use and Sale (hereinafter "T&Cs") aim to define the terms of provision of the FredLooX platform (hereinafter "the Platform") and the conditions of use of the service by the User. The Platform is an intermediary service connecting bike owners (hereinafter "Owners") and individuals wishing to rent them (hereinafter "Renters"). FredLooX acts as an intermediary.
Within the meaning of these T&Cs, the following terms are defined as:
Access to the Platform is free. To use the rental services, the User must create an account, be at least 18 years old, and have full legal capacity. The User agrees to provide accurate, complete information and to keep it up to date.
The User is solely responsible for the confidentiality of their password and the use of their account. They agree not to disclose it. Any connection or transaction made via their account will be deemed to have been made by them.
The User agrees to use the Platform fairly and not to circumvent the FredLooX booking and payment system. It is strictly forbidden for Owners and Renters to use the Platform's messaging system to exchange personal contact information (phone number, email, etc.) with the aim of concluding a rental outside the Platform.
Any proven attempt or actual circumvention of FredLooX's services to avoid paying the service commission will result in the immediate suspension and potentially the permanent deletion of the concerned User's account, without notice or compensation.

The Renter submits a booking request via the Platform. If the Owner does not use "instant book", they have a period to accept or refuse the request. Upon acceptance (manual or instant), the Renter is prompted to pay.
Payment is made via the secure Stripe system. The booking is only confirmed after payment is received. If payment is not made within 24 hours of acceptance, the booking request expires.
The prices displayed on the Platform are set by the Owners.
Refund for Early Return: For rentals longer than 24 hours, if the Renter performs the Check-out more than 24 hours before the scheduled end time, a 50% (fifty percent) refund for the unused full days will be automatically issued.
No-Show: If the Renter does not show up for Check-in and has not canceled their booking, no refund will be issued, and the Owner will receive their earnings.
Cancellation policies are defined by the Owner and visible on each listing:
Service and insurance fees are non-refundable. If the Renter cancels within the refundable period, the refund is calculated on the rental price only.
In case of cancellation initiated by the Owner, the Renter is fully refunded (rental price and service/insurance fees).
To protect the Owner's equipment, each rental is subject to a guarantee, which takes one of two forms:
In the event of damage, theft, or non-return of the bike, the Owner must report it via the "Report an issue" function on the Platform within 24 hours of the scheduled rental end time.
Reporting a dispute suspends the release of the deposit (if applicable) or initiates the claim process (if insured). The Renter is notified and invited to provide their version of events via the Platform's messaging system.
FredLooX administrators will act as arbitrators. Based on the evidence provided by both parties (descriptions, photos, messages), FredLooX will make a final decision, including the full or partial capture of the deposit. The decision of FredLooX is binding. In the event of a deduction from the deposit, a 15% dispute management fee will be deducted from the amount paid to the Owner.
FredLooX acts as a simple intermediary. FredLooX is not a party to the rental agreement concluded between the Owner and the Renter. Consequently, FredLooX cannot be held responsible for the actions or failures of either party, nor for the condition of the bikes, incidents, thefts, or damages occurring during the rental.
FredLooX strives to keep the Platform accessible 24/7 but cannot guarantee uninterrupted availability. FredLooX's liability cannot be engaged in case of service interruption, maintenance, bugs, or force majeure.
FredLooX is committed to protecting its Users' personal data in accordance with the GDPR. Users are invited to consult our Privacy Policy, which is an integral part of these T&Cs.
This policy details the data collected, the purposes of processing, retention periods, recipients (including Stripe and Sharelock), and how Users can exercise their rights.
The "FredLooX" brand, logos, site design, and all content (texts, images) created by the Platform are the exclusive property of FredLooX EI. Any reproduction, even partial, is prohibited without prior written authorization.
FredLooX reserves the right to modify these T&Cs at any time. Users will be informed of any substantial changes by e-mail or via a banner on the site. Continued use of the Platform after a modification constitutes acceptance of the new T&Cs.
These T&Cs are subject to French law. In the event of a dispute, and after an attempt to find an amicable solution, exclusive jurisdiction is given to the competent courts of Pointe-à-Pitre.
